حکومت کے 18 جنوری سے تعلیمی اداروں کو دوبارہ کھولنے کے فیصلے کو لاہور ہائی کورٹ میں چیلنج کرتے ہوئے طلباء اور ان کے اہل خانہ کی زندگیوں کے لیے نقصان دہ قرار دیا گیا ہے۔
درخواست گزار سید فیصل جی میرا نے عدالت سے استدعا کی کہ حکومت کے فیصلے کو غیر قانونی قرار دیا جائے اور حکام کو ہدایات جاری کی جائیں کہ اسکولوں کو محفوظ ماحول کی فراہمی تک بند رکھا جائے اور طلباء کو ویکسین، آمدورفت، صحت اور کھانے کی سہولیات کی فراہمی کے ساتھ ساتھ معاملات کی نگرانی کرنے والے افراد کی طلبا میں کورونا وائرس پھیلانے کی صورت میں مخصوص ذمہ داری طے کی جائے۔
درخواست گزار نے متاثرہ طلبہ اور ان کے اہل خانہ کو مالی امداد کے مکمل منصوبے کی فراہمی کا بھی مطالبہ کیا۔
انہوں نے اپنی درخواست میں کہا کہ متعلقہ حکام کو آن لائن کلاسوں کا بندوبست کرنے اور طلبہ کو آن لائن کلاسوں اور امتحانات کے لیے ہر ممکن مدد فراہم کرنے کا حکم دیا جائے۔
درخواست گزار نے درخواست کو نمٹانے تک حکومت کوتعلیمی ادارے کھولنے سے روکنے کا بھی مطالبہ کیا۔ درخواست گزار نے وزارت تعلیم پنجاب کے ذریعے چیف سیکرٹری، سکریٹری برائے اعلیٰ تعلیم اور دیگر کو فریق بنایا ہے۔ انہوں نے کہا کہ جب پاکستان میں کورونا وائرس کی سطح کم تھی تب اسکول بند کردیئے گئے تھے۔ ان کا کہنا تھا کہ اسکولوں کی بندش کی سب سے بڑی وجہ انتظامیہ، اساتذہ اور طلبہ کی حفاظتی تدابیر اختیار کرنے میں ناکامی تھی۔
درخواست گزار نے مزید کہا کہ مالی مشکلات کی وجہ سے حکومت کے لیے طبی اور صحت کی سہولیات کا انتظام کرنا اور منصوبہ بندی کے مطابق کورونا وائرس سے نمٹنے کے لیے لاگت کا انتظام کرنا مشکل تھا۔
انہوں نے بتایا کہ ضلعی سطح پر کورونا وائرس کے علاج کے لیے ہر اسکول کو ہیلتھ کیئر سینٹر سے جوڑنا ناممکن ہے۔ انہوں نے یہ بھی دعویٰ کیا کہ کورونا وائرس سے بچاؤ کے حفاظتی ایس او پیز سے متعلق تمام عملے کی تربیت کرنا ایک مشکل امر ہوگا۔
Government decision to reopen schools challenged in Lahore High Court
The government’s decision to reopen educational institutions from January 18 has been challenged in the Lahore High Court, declaring it detrimental to the lives of students and their families.
Petitioner Syed Faisal Ji Meera petitioned the court to declare the government’s decision illegal and issue directions to the authorities to close schools until a safe environment is provided and students are provided with vaccines, transportation, health, and food. In addition to the provision of facilities, special responsibility should be laid down in case of transmission of Coronavirus among the students of the supervisors.
The petitioner also demanded the provision of a complete financial assistance scheme to the affected students and their families.
He said in his petition that the concerned authorities should be directed to arrange online classes and provide all possible help to the students for online classes and examinations.
The petitioner also demanded that the government stop the opening of educational institutions till the petition is disposed of. The petitioner has made the Chief Secretary, Secretary for Higher Education, and others a party through the Punjab Ministry of Education. He said that schools were closed when the level of coronavirus was low in Pakistan. He said that the main reason for the closure of schools was the failure of the administration, teachers, and students to take safety measures.
The petitioner added that due to financial difficulties, it was difficult for the government to manage medical and health facilities and to manage the cost of dealing with the coronavirus as planned.
He said it was impossible to link every school to a health care center for the treatment of coronavirus at the district level. He also claimed that it would be difficult to train all staff on coronavirus protection SOPs.
